Question
How much is the rate of amil's commission following Islam? What is the Fatwa committee's view on the decision of the Muis Fitrah committee in determining the amils commissions?
Answer
Allah had determined that those who have a share of the zakat is the 8 asnafs (category) stated in Allah's firman in Surah Attaubah ayat 60.

"Donations(zakat)
are only for those who are poor,destitute, amils who
manage the zakat, muallafs who need to tame their
heart, those who wants to free themselves from the
shackles of slavery, those who are in debt and and
for spending in the road of Allah and those musafir
(who are a short of money) during their journey. One
resolution law that comes from Allah, and Allah Knows
More, and Very Much Intelligent ."
From these 8
asnafs, 5 of them are helped because of their needs.
They are the fakir, the poor, riqab, gharimin and
ibnussabil (those who are stranded in their journey).
2 of the Asnafs, are given assistance as they support
the religious struggle, they are fisabilillah and
muallaf. And the asnaf who manage the job of collecting
and disbursing the zakat are the amils.
Islamic scholars have determined
that the amils are those who do work concerning with
the collection and disbursement of zakat; This also
includes the counters, assessors, those who safekeep,
zakat manage or disburse the zakat.
The rate of commissions received
by the amils is in accordance to the amount of work
that they do. Imam Nawawi in his kitab Raudatut Talibin
wa Umdatul Muftiyin Juz II m.s 327 had explained that:
"Amil
commissions are given according to the amount of work
that they do. The Imams (group who are responsible
about religion) can (sah) ask the amil to collect
zakat without any conditions and after he finishes
his job, he is a given commission according to the
job that he does. And if the party concerned, wants
to set the payment as a salary towards a job done,
or as an agreement upon a job done, then the payment
can be taken from the zakat collection. The amils
cannot ask for more than that."
Based on this factor, the Muis Fatwa committee had
decided that the Fitrah committee's decision in determining
the amils' commissions is not wrong from the viewpoint
of law(hukum).
